Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Vibely mobile application and related services (the “Service”) operated by Vibely (“we”, “our”, or “us”).

By accessing or using Vibely, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.

1. Eligibility

You must be at least 13 years old to use Vibely. By using the Service, you confirm that you meet this requirement.

2. Accounts

When you create an account with us, you must provide accurate, complete, and up-to-date information.
You are responsible for safeguarding your account and for all activities that occur under your account.
Do not share your login credentials with others.
Notify us immediately of any unauthorized use of your account.

3. Use of the Service

Vibely is a platform designed to connect creators (influencers, micro-influencers, and users) with businesses (restaurants, cafes, hotels, and similar).

By using Vibely, you agree:

To use the Service only for lawful purposes.
Not to post or share any offensive, harmful, or misleading content.
Not to attempt to hack, exploit, or misuse the Service in any way.
To respect agreements made between creators and businesses through the app.

4. Collaborations and Transactions

Vibely facilitates collaborations between users and businesses but is not a party to agreements made between them.
Businesses are responsible for honoring offers, perks, or payments promised through the app.
Creators are responsible for delivering the content they commit to (e.g., posts, stories, videos).
Vibely is not liable for disputes between users and businesses but may provide mediation support.

If payment features are enabled:

Vibely may process transactions on behalf of businesses and creators.
Vibely may take a commission fee for such transactions, disclosed at the time of payment.

5. Subscription and Fees

Certain features of Vibely may be available through paid subscriptions.
Subscription fees are billed in advance.
Fees are non-refundable except where required by law.
Vibely reserves the right to change pricing with prior notice.

6. Content Ownership

You retain ownership of the content you post on Vibely.
By posting content, you grant Vibely a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the Service for operational and promotional purposes.
You are responsible for ensuring that your content does not infringe on third-party rights (such as copyrights, trademarks, or privacy rights).

7. Termination

We may suspend or terminate your account if you:

Violate these Terms
Misuse the Service
Engage in fraudulent, harmful, or unlawful activities

Upon termination, your right to use Vibely will immediately cease.

8. Limitation of Liability

Vibely provides the Service “as is” and “as available.”
We do not guarantee uninterrupted or error-free operation.

To the fullest extent permitted by law:

Vibely shall not be liable for indirect, incidental, or consequential damages.
Vibely is not responsible for issues arising from third-party services, businesses, or users.

9. Changes to These Terms

We may update our Terms and Conditions from time to time.

Any changes will be effective once posted in the app. By continuing to use Vibely, you agree to be bound by the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cyprus (or the country of incorporation of Vibely).
